Would your insurance cover this?

The answer is simple... Yes, No and Maybe. That's not confusing at all is it? We have a yes, no and maybe because there are three vehicles involved in this incident. There is the car driven by Kathy Bates, the parked VW bug and the parked van (that the VW gets pushed into). Let's start with Kathy Bates.

Most likely, She will not be covered at all. This is because most auto policies have a clause that excludes intentional acts, even if you have a momentary lapse of "control". So her statement that she's older and has more insurance is just movie fantasy, her insurance is not covering anything. Since this was an intentional act and is excluded, that means her insurance doesn't have to pay to fix the VW Bug or the van. This is solely Kathy Bates responsibility.

What about the mean girls that took her parking spot? They will be covered if they have auto insurance and have chosen physical damage coverage. Physical damage is comprehensive and collision.

Lastly, there was another vehicle damaged in this parking lot road rage. The van was also damaged. The van may also be covered if it has an auto policy with physical damage coverage. If either of these parked vehicles doesn't have insurance or has liability only insurance, they aren't getting any money from anyone's insurance. Their only recourse is to take legal action against Kathy Bates.

So in this case, the VW Bug and the van are going to have to file a claim with their own insurance company. If they have a deductible, they have to pay it. Once the claim is filed and paid, their insurance companies will most likely try to get their money back by taking legal action against Kathy Bates.

Moral of the story: Control your rage!...and consult with your agent to be sure you have the right coverage for what may happen. And, be sure you understand what is not covered under all your insurance policies. This may be the cause of more concern then what is covered!
